All-Inclusive Real Estate Experience Terms & Conditions

All terms and conditions can be amended to fit your personal goals, at our discretion.

Services included in this package:

  • All typical and accepted Listing services are included.
  • Staging consultation and complete home staging before listing for sale.
  • Pre-listing services to increase curb appeal. Landscaping maintenance and snow removal are included at the discretion of the Brokerage during the listing term.
  • Pre-home Inspection to identify any issues that would discourage an offer below the asking price.
  • Downsizing services to organize, de-clutter, donate, and remove items to maximize presentation to buyers.
  • Storage facilities if needed for short term, not to exceed 3 months unless approved.
  • Buyer services to find your perfect next home. Status Certificates for condos are included in our fees.
  • Cleaning services pre-listing and post-purchase, as required.
  • Moving services include packing, moving, and unpacking. Any special items requiring above-standard services (extra large items, piano, fine art etc.) must be approved before inclusion in this package.
  • Donation services for unwanted items. Qualified items will be donated to The Halton Womens Place.
  • Junk/hoarding removal is subject to pre-approval.
  • Any other service that the Brokerage feels appropriate and financially possible to ensure a stress-free and effortless experience.

Terms:

(These terms may be altered/amended at the discretion of Team Gemini. Partial services may be available to those who do not qualify for the complete package.)

  • This package does NOT require any security deposit from the Client(s).
  • A Listing Agreement and a Buyer Representation Agreement must be completed before services are provided.
  • The Listing term must be for 6 months or longer.
  • Total sales volume must exceed $3,000,000 (sale and purchase combined total)
  • All services must be approved by Sean Hartley of RE/MAX Escarpment before any service/work is started.
  • Should the Seller(s) wish to use specific services that are not approved by Sean Hartley of RE/MAX Escarpment, it will be at their sole expense and payment is due at the time services are rendered or at the terms set out by the service provider.

Services and Terms may be amended from time to time at the discretion of the Brokerage.

Buyer's Obligations and Services Agreement

The Buyer acknowledges and agrees to the following terms in relation to the real estate transaction facilitated by Sean Hartley of RE/MAX Escarpment Realty Inc.:

  1. Moving and Downsizing Services: The Buyer acknowledges and understands that as part of this agreement, Sean Hartley of RE/MAX Escarpment Realty Inc. will provide downsizing services, moving services, and cleaning services, all of which will be at his sole expense. These services are intended to assist the Buyer in the process of relocating to their new residence.
  2. Listing and Selling Obligation: The Buyer commits to listing and selling their current home, which is located at [insert address], with Sean Hartley of RE/MAX Escarpment Realty Inc. within 60 days from the date of an accepted and firm Agreement of Purchase and Sale. The terms of the listing agreement shall not be less than 6 months, and the listing price for the property will be determined by Sean Hartley.
  3. Reimbursement Obligation for Failure to Comply: In the event that the Buyer fails to fulfill their obligation to list and sell their current home within the specified timeframe as outlined in clause 2 above, the Buyer shall be responsible for reimbursing Sean Hartley of RE/MAX Escarpment Realty Inc. for all expenses incurred by him in providing the aforementioned downsizing, moving, and cleaning services, as well as any additional costs related to this agreement. The reimbursement amount shall be calculated based on the actual expenses incurred and shall be paid no later than 30 days from the date of the Seller/Buyer’s receipt of written notice from Sean Hartley.

Seller's Obligations and Services Agreement

The Seller hereby acknowledges and agrees to the terms set forth in this clause in relation to the real estate transaction facilitated by Sean Hartley of RE/MAX Escarpment Realty Inc.:

  1. Comprehensive Services: The Seller acknowledges that Sean Hartley of RE/MAX Escarpment Realty Inc. will provide a range of services designed to enhance the sale of the property. These services include, but are not limited to, listing preparation, enhancing curb appeal, light touch-ups, staging, professional photography, strategic marketing, and cleaning services. All expenses related to these services will be incurred by Sean Hartley at his sole expense and are intended to facilitate the successful sale of the Seller’s home.
  2. Listing Agreement Terms: The listing agreement for the Seller’s property shall not be for a period less than 6 months. During this time, the listing price for the property will be determined by Sean Hartley, taking into consideration market trends and property valuation.
  3. Reimbursement Obligation for Non-Compliance: In the event that the Seller fails to adhere to the terms outlined in clause 2 above, including the failure to maintain the listing agreement for a period of at least 6 months, the Seller shall be obligated to reimburse Sean Hartley of RE/MAX Escarpment Realty Inc. for all expenses incurred by him in providing the aforementioned services. Such reimbursement shall be calculated based on the actual expenses incurred and shall be paid no later than 30 days from the date of written notice received by the Seller/Buyer.
  4. Expiry of Listing Agreement: In the event that the listing agreement expires without receiving any reasonable offers for the property, the Seller shall not be responsible for reimbursing any expenses incurred by Sean Hartley as detailed in clause 1.
